If Mr.Divay takes this case to a court of law the result would not be what he is expecting. Who broke the law first? Mr.Divay sent a false bank receipt as proof of payment and expected the seller to send the merchandise. Divay said that he intentionally sent a forger bank receipt. Suppose the seller had sent the radio, what would have Divay done if the seller filed a cheating case against Divay ? It is like a bounced check and even Divay's bank could prosecute him for falsifying the bank receipt. I am not siding the seller. But saying that what Divay had done is not correct. If he got suspicious he simply should have posted in the forum to enlighten the forum members. If Divay had sent the money and the seller sent an empty box then it would become completely different case and legal actions could be taken against the seller. But here no exchange of money was done and Divay lost nothing. BTW who paid the courier charges for the parcel sent? The situation is real ugly.

I would agree to the point as to Divay had made for the Payment but look at the experience and knowledge Divay had the Guts to do it  , had he not taken the  initiative to do it Some Bakra  :Pwould have been a prey for this act , Getting a Radio for such a cheap rate , we after being in this field for quite some time can just dream of it .. but for some new comers if they had paid , it would had been a shock of their life's and would never had come back to this Hobby .
Just Imagine a Situation if you or i paid the money and you would have got a A4 Sheet , You would be Frustrated in your life for taking up the hobby it self
NOW the result of all this would be dealings in future ......
Now i have a Futaba Radio to be sold i am now thinking ways how can i go ahead

If he actually went ahead and paid the money, I bet Mr Star would have deleted the account by now and we people would have been giving condolences.

There would have been no ground for fighting in a consumer court as no body paid taxes in the transaction with a 'Reciept' (the reason people like Mr Sanjeev insist on bill).
Divey did a Tehelka Kand, and you have to use 'Sam-Dam-Dand-Bhed' to do that. Read some 'Chanakya Neeti'.

What you gentlemen wise suggest would have been to nab Mr Star ? actually bear the burnt of paying 18k to be on the 'Legal' side. Please stop being so modest in today's world.

Lesson Learned: dont buy anything from a person who suddenly wakes from slumber on the forum or is outwardly new. At least try to get some referral from other members from the city before you fall prey to a lucrative offer.

I wouldn't have surprised if Nigerian scam kind of people, not concerned with the hobby at all make a post for sale of a highly desired item (Flybarless System, Align T-Rex, OS Engine, et all), not even having one, let the money transaction happen and get away. That bring to me, Has anyone heard about my Star actually flying in the fields ? is he one other member here playing prank, or some other general Internet fraud ? The swiftness in sending the empty package really smells fishy.

I had some hope until ...

1.  Two people were asked to send money.

2.  Local pickup was actively discouraged.

3.  Connection to the forum was being obfuscated for fear of something.

But the lesson from this thread is clear.  Anyone who attempts to con people using this forum (or others), let them BE PREPARED for some knocking on the door.  Let them also read well about the newly minted cyber crime statutes in our country, before venturing out to make some quick money !

I am not siding with the seller. I am simply telling what it would be if Divay takes this case to a court of Law. What we think as the correct thing to do may not be so in the eye of the law. That is the problem all over the world. I posted only after discussing the case with my Father-in-Law who is a Retired District Judge.

Rao Sir with due respect to you , I have a few points to state. I do believe in what you have said however, I did not want my money lying in an imposters a/c and I then fighting it for the rest of the coming years, that to with no guarantee wether it would come back or not...

As far as my crenditials are concerned here is a short story to tell you what they are :

I bought an mustang a couple of weeks back from praveen (pvn 2000)(flyrc) a member on the forum, the money for the same was transf to him via a cheque the item was a defective piece (fuselage damaged) on the runway itself during the maiden it cracked open from the center, I called praveen to let him know of the same (money still not recd by him as chq transfer was taking time) he acknowledged the same and said that it was one of case (I did not do a stop payment ) after a few days the payment was credited to praveen's A/c he called and thanked me for the same. A few weeks later praveen called and said that he was feeling sorry for what had happened and was willing to refund the money (very genrous of him) I refused the money on the pretext of his kind behaviour and the fact that he had no intentions of sending me the defective piece. (The above can be confirmed from praveen)

ALSO, There is a popular saying "A stitch in time saves nine" My stitch probably saved some others from getting conned.... that some other could have been you Mr. Rao....

I held back for a long time before posting again on this thread. At last, I feel compelled to post. What has happened is incredible. I don't deny that. Please note that I am not taking any sides here as I am NOT one of the affected parties.

All  have to say here is that whatever Mr. Rao has stated here is the sorry truth. The Law does not take action based on the nobility of intentions, at best it somewhat acknowledges 'bonafide or malafide intentions', it also hands down sentence on actions performed. No one here,  is saying that "Divay is wrong and Stunningstar is right". However, IF you pursued this matter in court and IF the other party could prove that you sent him a false bank transfer statement ( for whatever reason) the outcome could well be, beyond the expectations of your well wishers. 

If my words sound confusing to you, just walk in to the nearest Police station this morning and request to lodge an FIR about a lost cellphone, you will know what I mean. In 30 minutes, they will leave you frustrated with their cross questioning and you will begin to wonder whether the loss of a 10 K phone was worth all the harassment!

Another example, let us say that you called me and confessed to the murder of say, Jessica Lall and I happened to record it on my cellphone (without your knowledge). If I tried to submit that as evidence in court, I would first be arrested for recording a telephone conversation without your permission!

The Indian Penal Code is archaic, some time back I had read that the penalty for taking someone else's boat, without his permission, for a temporary joy ride down the river - WAS PUNISHABLE BY DEATH!!! As that action (taking his boat without his permission) tantamounted to stealing the said boat and that was seen as PIRACY, and according to the IPC,  Piracy was punishable by death!!!

No one doubts your intentions behind the actions, we just wish you well and do not want you to face any troubles in future. God forbid, if that were to happen, I wonder how many of us would spend their hard earned money and time to stand by you and back you up when required. I regret if I sound callous, I am just being practical.

Thank you VC sir, I greatly appreciate your advise, but unfortunately I am not running away from anything, a case for the same has already been registered ... I belong to a family of advocates both criminal and civil.... I am pursuing the case after consulting them...
