URGENT INFORMATION FOR EVERYONE!!!

My FedEx shipment containing Turnigy Lipo & other items from HobbyKing has arrived today at my home city. Local FedEx people called me up today to inform me about my parcel and told me that I'll hav to pay a Customs Duty of Rs 2912. My order value was $96 and shipping was $44. When calculating duty, they took total of order value & shipping charges ($96+$44=$140 = @62 = INR8,680). I said I would go to their office as I was not at home at that time to receive the parcel.

I went to their office in the evening and they brought the parcel. However, they could show me the invoice saying that they received it by email and haven't printed it yet (suckers!!). They said they can give a payment receipt for the money that I pay today and give me the Customs receipt tomorrow. However, I declined to accept the parcel because the rate is RIDICULOUSLY high!! They will give me the Invoice tomorow, so I'll know the rate slabs tomorrow.

In the meantime, after reading the THE CUSTOMS TARIFF ACT, 1975 & its First and Second Schedules LINE-by-LINE, I have summarised the following rates:

Basic Customs Duty Rate is 10% flat + Education Cess 3% + Special Additional Duty 4% + CounterVailing Duty 10% + Brokerage Charge by FedEx

Notes:

1. Special Additional Duty (SAD) of Customs is imposed at the rate of 4% in order to provide a level playing field to indigenous goods which have to bear sales tax.

2. CounterVailing duty (CVD) is imposed on a like product manufactured or produced in India, if the imports cause or threaten to cause material injury or material retardation of the establishment of a domestic industry. As far as I know, LiPo batteries are not manufactured in India. All LiPos are imported from China by Indian merchants.

Please give your views and suggestions.

Hi frnz. Brought the Parcel and paid the duty. After going though the Customs Rule Book and the Customs Tariff Act, I can only say that (even though I am upset) FedEx people followed by the book when charging me the duty taxes. So I have no complaints against them.

Having said that, I would like to let you know that there are certain provisions in the Acts which provide for 5% & NIL tax rates for items such as Batteries, Electrical accessories and so on. But for that, I would have to apply for a Tax refund with the Central Board of Excise and Customs along with my own calculation, justifications & quotations from the Rule Book. I don't want to do that now because I have other things to do and moreover, I think I didn't make severe losses by paying for Customs Duty.

I made some calculations and found that if I take the total price of the products separately and consider Shipping Costs + Charge for using Debit Card + Customs Duty as TAX, my total tax comes out to be 64.6%. For the product prices, I selected what I PAID FOR (using Buddy Codes & One Time Offers), not the original prices shown on HobbyKing. After adding this TAX to the HobbyKing price of each of the products that I paid, I found this:

1. Turnigy Accucel-6 50W 6A Balancer/Charger w/ accessories = Rs 2346 per piece
2. Turnigy nano-tech 2200mah 3S 25~50C Lipo Pack = Rs 1048 per piece
3. Turnigy nano-tech 3300mah 3S 35~70C Lipo Pack = Rs 3264 per piece (very costly)
4. Nylon T-Connectors (Deans Plug) = Rs 35.7 per pair
5. PolyMax 3.5mm Gold Connectors = Rs 17.65 per pair

and others...

Please note that the above prices include SHIPPING COSTS. Hats Off

I think this aptly summarises the title of this thread Anything and Everything - Hobby King  Thumbs Up

I have attached my Customs Invoice from FedEx for reference.

After reading and re-reading the Customs Act & Customs Tariff Rules, I have come to the conclusion that Customs Duty is calculated as follows:

Let Assessable Value = U
BCD-Basic Customs Duty = 10% of U = V
CVD-Countervailing duty = 12% of (Assessable value + BCD) = 12% of (U+V) = W
Education Cess or Secondary and Higher Education Cess/CESS Applies on both customs and excise duties
Calculated as: Education Cess on CVD duty = 3% of CVD = 3% of W = X
Calculated as: Education Cess on Custom Duty - 3% of (BCD+CVD+Cess on CVD) = 3% of (V+W+X) = Y
SAD- Special additional duty = 4% of (Assessable value+BCD+CVD+Educ.Cess on CVD+Educ. Cess on Custom duty) = 4% of (U+V+W+X+Y) = Z

Total Duty = V + W + X + Y + Z + Service Tax + Brokerage charges (only applicable for Courier Companies not for IndiaPost)

In my case:

U = 8927
V = 893
W = 1,178
X = 35
Y = 63
Z = 442

Total Duty = 2,611 + Service Tax + Brokerage charges

I can assure you that the method is correct. Please double check my calculations and point them if anything is wrong. Rates may be different. I have taken the rates as given in the FedEx invoice.

However, you'll notice that X has not been charged in my invoice. Don't know why. Percentage tax in my case come out to be 28.85%

Now you can know how much Customs Duty (maximum) you'll have to pay when ordering ANYTHING & EVERYTHING fro HobbyKing!!!

Applicable only when ordering through EMS, Air Parcel & Couriers (DHL, FedEx etc)  Hats Off

Few pics of my package. I opened it in the FedEx office to check and verify its contents. So couldn't take picture of the closed box.

@dhruva. Use the full shipping weight available to you in your applicable slab. Buy other items along with the battery.

I called up FedEx Customs clearance section today. There is no GOVT CUSTOMS OFFICER there sorting things out, as far as I could make out. They calculate the duty on their own by following the Customs Rule Book. This calculation in turn is checked by Customs Officers later. By the conversation that I had, it seemed that they dont verify the actual price of the product.  Thumbs Up  Drool
